STUDIO EVERART — COMBINED SALES, SHIPPING & RETURNS POLICY

1. TAX INFORMATION (REGIME FORFETTARIO)

• VAT Exemption: Studio Everart operates under the Italian "Regime Forfettario" (Art. 1, paragraphs 54 to 89, Law n. 190/2014).

• Final Price: No VAT (IVA) is charged on any products or services; the price displayed is the final amount due for the item.

• Non-EU Duties: For deliveries outside the European Union, the Buyer is solely responsible for any import duties, local taxes, or customs clearance fees.

2. SHIPPING & DELIVERY

• Flat Rate Shipping: We apply a standard flat rate for shipping, which is clearly calculated and added at the checkout stage.

• Pre-Order Dispatch: Shipment occurs only after the full balance (deposit + remaining balance + flat shipping fee) has been received.

• Transfer of Risk: The risk of loss or damage passes to the Buyer only when they, or a designated third party, take physical possession of the goods.

• Mandatory Inspection: Upon delivery, the Buyer must inspect the outer packaging for signs of damage before signing the carrier's document.

• Received with Reservation: If external damage is visible, the Buyer must write "consegnato con riserva" (received with reservation) on the delivery document to preserve the right to a claim.

3. PURCHASE OPTIONS & CANCELLATION

• Standard Orders: Cancellation is only possible before the order has been dispatched.

• Pre-Orders (Caparra Confirmatoria): The Deposit paid at the time of a Pre-Order constitutes a "caparra confirmatoria" pursuant to Art. 1385 of the Italian Civil Code.

• Buyer Cancellation: If a Pre-Order is cancelled before the availability notification, 80% of the Deposit is refunded, while 20% is retained as a non-refundable booking fee.

• Buyer Default: If the balance is not paid within 90 days of the availability notification, Studio Everart is entitled to retain the full Deposit.

4. RIGHT OF WITHDRAWAL (RETURNS)

• Timeline: Consumers may withdraw from the contract within 14 calendar days of physical receipt of the goods.

• Product Condition: To be eligible for reimbursement, goods must be intact, in their original undamaged packaging, and include all accessories and certificates.

• Reimbursement Scale: For voluntary returns of perfect-condition limited edition items, the reimbursement is capped at 80% of the original price to reflect the loss of "first-sale" collectible value.

• Return Shipping: The direct cost of returning the goods is borne by the Buyer.

5. LEGAL GUARANTEE OF CONFORMITY

• Coverage: All products are covered by a 2-year legal guarantee for manufacturing defects.

• Reporting Deadlines: Internal damage must be reported within 48 hours of delivery; manufacturing defects must be reported with photographic evidence to info@studioeverart.com.

• Remedy: Confirmed defects entitle the Buyer to free repair or replacement. Given the nature of limited edition collectibles, the timeframe for this may range from 3 to 6 months.
