PRE-ORDER & CANCELLATION POLICY — STUDIO EVERART

1. DEPOSIT AND BOOKING FEE (CAPARRA CONFIRMATORIA)

All pre-orders require a non-refundable deposit (caparra confirmatoria) generally set between 10% and 20% of the product's final price, subject to minor commercial rounding. The exact percentage is fixed at the launch of each statue/edition and remains unchanged for the entire duration of that specific pre-order; it may differ from one edition to the next. The exact amount is clearly stated on the product page and confirmed at checkout.

The deposit is due at the time the pre-order is confirmed. The remaining balance must be paid according to the terms set out in Section 4.

2. RIGHT OF CANCELLATION WITHIN 14 DAYS

You have the right to cancel your pre-order within 14 days of paying the deposit and to receive a full refund of the amount paid, without providing any reason.

To exercise your right of cancellation:

• Contact info@studioeverart.com with your order number
• Send a written notice within the 14-day period
• The refund will be processed within 14 days of receiving your request

After the 14-day period, the deposit becomes non-refundable and is allocated to production costs (mould setup, raw materials, craftsmanship).

3. PRODUCTION TIMELINE AND NOTIFICATION

Once the pre-order phase closes:

• Studio Everart will notify you by email of the estimated production start and completion dates
• We will send periodic updates on production progress
• If production is delayed by more than 2 weeks beyond the estimate, we will proactively notify you with a new estimated completion date (ETA)

4. BALANCE PAYMENT AND SHIPPING

The balance (80–90% of the price, depending on the deposit percentage fixed for that statue) must be paid within 90 days of the notification that the product is ready for shipping.

Accepted payment methods: credit card, PayPal, bank transfer.

If the balance is not paid within the 90-day deadline, Studio Everart reserves the right to cancel the order and retain the deposit as compensation for the costs incurred and the production capacity occupied.

5. PROTECTION IN CASE OF DELAY BY STUDIO EVERART

If Studio Everart fails to meet the communicated estimated completion date (including any subsequent updates), you are entitled to:

• A full refund of the deposit and of any balance already paid, upon request; or
• An extension of the balance payment deadline until a new communicated ETA

This protection does not apply to delays caused by force majeure (embargo, natural disaster, international logistics disruption), which will be communicated as soon as possible.

6. SHIPPING

All orders are shipped insured. Shipping costs are flat rate by geographic zone and are communicated at checkout. Tracking will be provided once the parcel reaches the final carrier.

In case of loss or damage in transit, Studio Everart handles the insurance claim and either refunds the order or ships a free replacement piece.

7. RETURNS AND WARRANTY

Post-delivery withdrawal (EU right): You have 14 days from receipt of the goods to exercise your right of withdrawal without giving any reason. In this case, Studio Everart provides a prepaid return label. The goods must arrive in original condition, never displayed, with intact packaging.

Warranty: All pieces carry a 6-month warranty against manufacturing defects (casting, painting, assembly). Defects reported within 7 days of receipt are replaced or refunded at Studio Everart's expense.

APPLICABILITY AND TRANSITION

This policy is effective for all pre-orders in the Masters of Madness collection and subsequent releases. Prior orders (Statue I — H.P. Lovecraft) retain the terms declared at the time of payment (previous Refund Policy version, 80/20 split, 90-day balance).
